By accessing or using our website, placing an order, or utilizing any of our Services, you agree to be bound by these Terms, our Privacy Policy, and any other policies referenced herein. If you do not agree with any part of these Terms, you must not use our website or Services.

1. Definitions

"We," "Us," "Our," "Restful Nights" refers to Live Comfortably, LLC, a company registered under the laws of Florida.
"You," "Your," "Customer" refers to the individual or entity accessing or using our website and/or purchasing products/services from us.
"Website" refers to http://www.restfulnights.com.
"Products" or "Services" refers to the goods or services offered for sale on our Website.

2. Acceptance of Terms

By accessing or using this Site, you agree to abide by these Terms, as well as any additional terms, guidelines, or policies posted on the Site. We reserve the right to modify, update, or change these Terms at any time. Any changes will be posted on this page, and the date at the top will be updated to reflect the latest version. Your continued use of the Site after such changes constitutes your acceptance of the modified Terms.

This Website is offered and available to users who are 18 years of age or older, and reside in the United States or any of its territories or possessions. By using this Website, you represent and warrant that you are of legal age to form a binding contract with us and meet all of the foregoing eligibility requirements. If you do not meet all of these requirements, you must not access or use the Website.

3. Products and Services

3.1 Product Descriptions: We strive to ensure that all descriptions, images, and prices of Products displayed on our Website are accurate. However, we do not warrant that Product descriptions or other content on the Website are completely accurate, complete, reliable, current, or error-free. Colors and appearances of Products may vary slightly due to monitor settings and photographic lighting.

3.2 Pricing: All prices are listed in USD and are subject to change without prior notice. The price charged for a Product will be the price in effect at the time the order is placed. We reserve the right to correct any pricing errors or omissions.

3.3 Availability: All Products are subject to availability. We reserve the right to limit the quantity of Products we supply, to refuse service to any customer, or to cancel any order at our sole discretion. In such cases, we will issue a refund if payment has already been processed.

4. Ordering and Payment

4.1 Order Acceptance: Your placement of an order on our Website constitutes an offer to purchase the Products. Our acceptance of your order occurs when we send you an email confirmation indicating that your order has been shipped. We reserve the right to refuse or cancel any order for any reason, including but not limited to Product unavailability, errors in pricing or product descriptions, or suspected fraudulent activity.

4.2 Payment Methods: We accept various payment methods, including major credit cards (Visa, MasterCard, American Express, Discover), debit cards, Shop Pay, Apple Pay, Google Pay, and Shop Pay Installments (powered by Affirm), Paypal and Venmo. By providing payment information, you represent and warrant that you are authorized to use the designated payment method.

4.3 Payment Processing: Payment authorization is established at the time of order placement. Collection/capture of funds occurs when product is fulfilled and shipped. In the event of a failed payment, chargeback, or reversal, you agree to be responsible for any resulting fees or losses incurred by us. We reserve the right to pursue collection of any unpaid amounts.

5. Shop Pay and Shop Pay Installments

5.1 General Shop Pay: Shop Pay is an accelerated checkout service (including major credit cards and third-party payment services like Google Pay and Apple Pay) that allows you to save your payment and shipping information for faster future purchases. Your use of Shop Pay is subject to Shopify's terms and conditions and privacy policy.

5.2 Shop Pay Installments (Powered by Affirm):

A. Overview: Shop Pay Installments allows you to split your purchase into bi-weekly or monthly payments. This service is provided by Affirm and is subject to their credit approval and separate terms and conditions.

B. Eligibility: Eligibility for Shop Pay Installments is determined by Affirm and may depend on factors such as your creditworthiness (a soft credit check may be performed for bi-weekly payments; monthly payments may involve a credit check that could impact your credit score), your location (currently available for eligible customers in the U.S. and Canada, excluding Quebec), and the total order value. Not all products or orders may be eligible for Shop Pay Installments (e.g., gift cards, subscriptions, and certain B2B purchases are typically excluded).

C. Payment Schedule & Fees: Bi-weekly Payments: For purchases typically between $50 - $999.99 USD, you may be eligible for four interest-free bi-weekly payments.

D. Monthly Payments: For purchases typically between $150 - $17,500 USD, you may be eligible for monthly payments, which may be interest-bearing. There are generally no late fees for Shop Pay Installments, but terms may vary, and you should always refer to the specific terms provided by Affirm at the time of your loan agreement.

E. Direct Relationship with Affirm: When you choose Shop Pay Installments, you are entering into a loan agreement directly with Affirm (or their lending partners), not with Restful Nights or Live Comfortably, LLC. We receive the full payment for your order from Shopify, and your repayment obligations are solely with Affirm.

F. Customer Support for Installments: For any questions regarding your Shop Pay Installments account, eligibility, payment schedule, or loan terms, please contact Shop Pay support directly at Shop Pay Help Center or Affirm customer service. Live Comfortably, LLC does not have access to your loan information.

G. Promotional Disclosures: Any promotional offers or examples related to Shop Pay Installments on our Website are for illustrative purposes. Your actual loan terms, interest rates, and approval are subject to Affirm's assessment and will be presented to you during the checkout process.

6. Taxes

State sales tax will be calculated and reflected in your Order Summary at checkout, after the shipping address has been entered. Sales tax is applicable to the following states including taxes collected by individual counties therein: Alabama, Arizona, Arkansas, California, Colorado, Connecticut, Florida, Georgia, Hawaii, Idaho, Illinois, Indiana, Kentucky, Louisiana, Maine, Maryland, Massachusetts, Michigan, Minnesota, Missouri, Nebraska, Nevada, New Jersey, New York, North Carolina, North Dakota, Ohio, Oklahoma, Pennsylvania, Rhode Island, South Carolina, South Dakota, Tennessee, Texas, Utah, Vermont, Virginia, Washington, West Virginia, Wisconsin, and Wyoming.

7. Shipping and Delivery

7.1 Shipping Costs: Shipping costs will be calculated and displayed at checkout.

7.2 Delivery Times: Estimated delivery times are provided for your convenience but are not guaranteed. Delays may occur due to unforeseen circumstances or carrier issues. We are not responsible for delays caused by the shipping carrier or customs.

7.3 Risk of Loss: The risk of loss and title for Products purchased from the Website pass to you upon our delivery to the carrier.

8. Returns, Refunds, and Exchanges

8.1 Return Policy: We accept returns of unused and undamaged Products within 30 days upon receiving delivery. To initiate a return, please visit our Returns Policy page.

8.2 Refund Process: Refunds will be processed to the original payment method used for the purchase.

A. For standard payments (credit card, debit card, Apple Pay, Google Pay, Shop Pay, Paypal, Venmo): Refunds will be issued back to your original payment method within 7-10 business days after the returned Product is received and inspected.

B. For Shop Pay Installments: Once we process your refund for a Shop Pay Installments purchase, Affirm/Shop Pay will adjust your loan balance. If you have made payments that exceed the adjusted balance, Affirm will refund the overpayment to your original payment method. Any interest paid on interest-bearing loans is generally non-refundable by Affirm. Please allow time for Affirm to process the refund to your account.

8.3 Exchanges: We do not offer direct exchanges. Please return the unwanted item for a refund and place a new order for the desired item.

9. Restful Nights Loyalty Program

9.1 Enrollment and Acceptance: By enrolling in or participating in Restful Rewards, our Restful Nights loyalty program, you expressly consent to be bound by these Terms, including any updates or amendments made hereto as well as our Privacy Policy. Should you disagree with any part of these Terms or our Privacy Policy, your sole recourse is to discontinue participation in Restful Rewards.

9.2 Eligibility: Participation in Restful Rewards is contingent upon being at least 18 years of age and maintaining an active account with our entity. Restful Rewards is void where prohibited by law or any regulatory framework, and it is incumbent upon participants to ensure their eligibility within the confines of local laws and regulations.

9.3 Mechanics of the Restful Rewards: Upon joining Restful Rewards, participants will accrue points or rewards (“Rewards”) based on qualifying activities, which include, but are not limited to, purchases, referrals, and specific promotional actions, as detailed on the Restful Rewards program page on our website. The accrual, redemption, and specifics of these Rewards are subject to change at our discretion, in line with Restful Rewards structure and objectives.

9.4 Non-Transferability of Rewards: Rewards earned through Restful Rewards are non-transferable and may not be exchanged for cash or other substitutes unless specifically permitted by Restful Rewards terms. The sale, barter, transfer, or assignment of any accumulated Rewards, other than by us, is expressly prohibited.

9.5 Restrictions: Participants may not engage in any fraudulent or abusive activities aimed at unjustly accumulating Rewards. Such activities include, but are not limited to, creating multiple accounts for the same individual or engaging in deceptive practices to generate referrals. We reserve the right to monitor accounts for suspicious activity and may adjust Rewards or terminate accounts accordingly.

9.6 Adjustments to Restful Rewards: We retain the right to modify, pause, or terminate the Restful Nights Loyalty Program at any time for any reason we deem appropriate. This includes changes to the structure, rewards, and eligibility criteria of the Restful Nights Loyalty Program. We will provide at least fourteen (14) days' prior notice of any material modifications or pauses to the program, and at least thirty (30) days' prior notice in the event of termination of the program, during which existing participants may redeem any accumulated Rewards. Participants will be informed of significant changes through updates to these Terms or other direct communications.

9.7 Limitation of Liability: Our liability in relation to Restful Rewards is limited to the extent permitted by law. We are not liable for any errors or omissions in the administration of Restful Rewards, including but not limited to, errors in the allocation of Rewards to participants.

9.8 Questions about Restful Rewards: For any questions or concerns regarding Restful Rewards, participants are encouraged to contact our customer service department through the designated channels provided on our website. Participation in Restful Rewards constitutes acknowledgment and acceptance of these Terms, which participants affirm to have read and understood prior to engagement. It remains the responsibility of each participant to apprise themselves of the Terms herein and any amendments thereto.

10. Restful Nights Referral Program

10.1 Enrollment and Acceptance: By participating in our Restful Nights Referral Program, you are agreeing to abide by these Terms and our Privacy Policy. If you do not agree to these Terms or the Privacy Policy, please refrain from participating in the Restful Nights Referral Program. It is your responsibility to read and understand these Terms before participating in the Restful Nights Referral Program. Your participation constitutes acceptance of all program rules, fraud prevention measures, and reward fulfillment processes outlined below.

We reserve the right to update these terms as the Restful Nights Referral Program evolves to include new features, security measures, or customization options. Continued participation in the Restful Nights Referral Program after any changes constitutes acceptance of the updated terms.

10.2 Eligibility: To be eligible for the Restful Nights Referral Program, you must be at least 18 years old and have an active account with our store. You may not participate in the Restful Nights Referral Program where doing so would be prohibited by any applicable law or regulations.

10.3 How the Restful Nights Referral Program Works: You will receive a unique referral link or code (“Referral Code”) to share with others by visiting our referrals page. Here's how the complete process works:

Step 1: Advocate Signup - You sign up for our referral program and receive your unique referral link.
Step 2: Share Your Link - You can share your referral link via email, social media, or direct messaging. The link can be customized with your personal message.
Step 3: Friend Claims Discount - When someone clicks your link, they can claim their discount by entering their email address. This creates a pending referral.
Step 4: Friend Makes Purchase - Your friend uses their discount code to make a qualifying purchase. The referral status becomes completed once the order is fulfilled.
Step 5: You Receive Rewards - After your friend's order is marked as fulfilled, you receive your referral reward as detailed on our Restful Nights Referral Program page.

10.4 No Self-Referral: You are not eligible for rewards by referring yourself. If you set up multiple accounts in order to receive referral benefits, all of your accounts may be terminated, and you will be disqualified from future participation in the Restful Nights Referral Program.

10.5 Limitations: Referrals are limited to one per household. If multiple members of the same household participate in the Restful Nights Referral Program, only the first person to participate will be eligible for referral rewards. Rewards are only for bringing new customers to the shop. If you try referring someone who has already made a purchase, the system won’t count it. You’ll receive your reward only after your friend’s order has been marked as fulfilled. This ensures the referred purchase is legitimate. Participants are prohibited from sharing the reward on popular coupon sites. The friend's discount reward is personal to the individual friend who claimed it and may not be transferred or shared with others.

10.6 Fraud Prevention and Security: To maintain Restful Nights Referral Program integrity and prevent abuse, we employ comprehensive fraud prevention measures, including the following. For more information regarding security and automated technologies, refer to our Privacy Policy.

IP Address Monitoring: We monitor IP addresses to prevent multiple referrals from the same location or household. Referrals from similar IP addresses may be blocked to ensure fairness.
Email Validation: Email addresses are validated to prevent fake or duplicate accounts. Similar email patterns may trigger additional verification requirements.
Account Verification: We verify that referred customers are genuine new customers and not pre-existing account holders attempting to circumvent Restful Nights Referral Program rules.
Automated Blocking: Our system automatically blocks referrals that show signs of fraudulent activity, including but not limited to similar IP addresses, existing customer attempts, advocate exclusions, and suspicious order patterns.

10.7 Disqualification and Blocking: We reserve the right to disqualify any user from the Restful Nights Referral Program at our discretion. Referrals may be automatically blocked or marked as ineligible for the following reasons:

Similar Email Addresses (e.g., when referred customers use email addresses too similar to existing customers)
IP Address Restrictions (e.g., multiple referrals from the same household or IP address)
Existing Customer Attempts (e.g., when someone who already has an account tries to claim a referral discount)
Advocate Exclusions (e.g., when the referring customer has been excluded from loyalty programs)
Suspicious Activity (e.g., any behavior that suggests fraud, abuse, or violation of these terms)

Additional reasons for disqualification include failure to comply with these Terms or any harmful conduct towards our brand, staff, or other customers.

10.8 Referral Program Presentation: Our Restful Nights Referral Program may be presented with customized branding, messaging, and imagery. Referral sharing options may include email, social media, and direct messaging. During the referral process, you and your referred friends may be given the opportunity to opt into email marketing communications from Restful Nights.

Email Integration: Referral sharing is integrated with email, allowing you to send personalized referral invitations to friends directly from the referral page.
Terms Integration: Links to these Terms are provided throughout the referral process, including on signup forms, friend claim pages, and reward pages, to ensure full transparency.
Marketing Preferences: During the referral process, you and your referred friends may be offered the opportunity to opt into email marketing from Restful Nights. Participation in email marketing is voluntary and not required to participate in the referral program.

10.9 Changes to the Restful Nights Referral Program: We reserve the right to modify, suspend or terminate the Restful Nights Referral Program at any time for any reason. We will notify you of any changes to the Restful Nights Referral Program by updating these Terms or through other communications.

10.10 Reward Fulfillment and Processing: Reward fulfillment follows a specific process to ensure accuracy and prevent fraud:

Timing: Rewards are processed only after the referred customer's order has been marked as fulfilled in our system. This typically occurs after the order has been shipped and delivered.
Verification Period: Some rewards may have a verification period to ensure the purchase is legitimate and not subject to returns or chargebacks.
Reward Types: Rewards may be issued as discount codes, store credits, points, or other benefits as specified in the program details. The type and amount of reward will be clearly communicated when you join the program.

10.11 Limitation of Liability: We are not responsible for any incorrect or inaccurate information supplied by participants while participating in the Restful Nights Referral Program.

11. Restful Nights Mobile

11.1 Restful Nights Mobile Terms & Conditions: Restful Nights offers its customers mobile alerts regarding sale promotions, event information, product launch announcements, cart reminders, back in stock alerts, price drop alerts, low inventory alerts by SMS message (the "Service") on 60598. By participating in the Service, you are agreeing to these Terms and to the Privacy Policy.

11.2 Signing Up and Opting-In to the Service: Enrollment in the Service requires you to provide your mobile phone number and to agree to these terms and conditions. You may not enroll if you are under 18 years old. Before the Service will start, you will need to agree to these Terms. Restful Nights reserves the right to stop offering the Service at any time with or without notice.

11.3 By opting into the Service, you:

A. Authorize Restful Nights to use an automatic telephone dialing system (autodialer) or pre-recorded voice messages to send recurring automated text messages to the mobile phone number associated with your opt-in (i.e., the number listed on the opt-in form or, if none, the number from which you send the opt-in, or, if none, the number on file for the account associated with your opt-in).

B. Acknowledge that you do not have to agree to receive messages as a condition of purchase.

C. Confirm that you are the subscriber to the relevant phone number or that you are the customary user of that number on a family or business plan and that you are authorized to opt in.

D. Consent to the use of an electronic record to document your opt-in. To request a free paper or email copy of the opt-in or to update our records with your contact information, call 1-888-297-1778 for assistance. To view and retain an electronic copy of these Terms or the rest of your opt-in, you will need (i) a device (such as a computer or mobile phone) with Internet access, and (ii) and either a printer or storage space on such device. For an email copy, you'll also need an email account you can access from the device, along with a browser or other software that can display the emails.

E. Consent to receive autodialed or prerecorded marketing mobile messages from Restful Nights regarding your account and our products and services, even if the mobile phone number you provided is registered on any state or federal Do Not Call list. This consent applies only to the specific number you have opted in with.

F. Agree to indemnify the Company in full for all claims, expenses, and damages related to or caused in whole or in part by your failure to notify the Company if you change your telephone number, including, but not limited to, all claims, expenses, and damages related to or arising under the Telephone Consumer Protection Act.

11.4 Content You May Receive: Once you affirm your choice to opt-in to the Service on 60598, your message frequency may vary. You may receive alerts about:

A. Sale promotions

B. Event information

C. Product launch announcements

D. Cart reminders

E. Back in stock alerts

F. Price drop alerts

G. Low inventory alerts

H. Additional marketing messages

11.5 Charges and Carriers: Message and data rates may apply. Please consult your service agreement with your wireless carrier or contact your wireless carrier to determine your phone's pricing plan and the charges for sending and receiving text messages. You acknowledge that you are responsible for any message, data or other charges incurred (usage, subscription, etc.) as a result of using the Service. Supported carriers include AT&T, T-Mobile, Verizon Wireless, Boost Mobile, Virgin Mobile, U.S. Cellular, Cricket, C-Spire, MetroPCS, and other regional carriers. The Service may not be available on all wireless carriers. Restful Nights may add or remove any wireless carrier from the Service at any time without notice. Restful Nights and the mobile carriers are not responsible for any undue delays, failure of delivery, or errors in messages.

11.6 To Stop the Service: To stop receiving text messages from Restful Nights, text the word STOP to 60598 any time or reply STOP to any of the text messages you have received from Restful Nights. This is the primary method for opting out. After texting STOP to 60598, you will receive one additional message confirming that your request has been processed.

11.7 Questions: You can text HELP for help at any time to 60598. This will provide you with Restful Nights Customer Service phone number: 1-833-468-4303 for assistance.

11.8 Changes to Terms: These Mobile Terms and Conditions are subject to change at any time. We will notify you of any material changes by posting the updated terms on our Website or, where appropriate, by sending a message to your mobile number. Your continued use of the Service after such changes constitutes your acceptance of the modified terms.

12. Marketing Communications and Consent

12.1 Consent to Marketing: By creating an account or placing an order, you may opt-in to receive marketing communications from us, including promotional emails, newsletters, and special offers. We will only send marketing communications to you if you have provided your express consent.

12.2 Opt-Out Mechanism: You may opt-out of receiving marketing communications at any time by: (a) clicking the "unsubscribe" link at the bottom of any marketing email; (b) updating your communication preferences in your account settings; or (c) contacting us directly at privacy@restfulnights.com. We will not be liable for any reason all or any part of the Website is unavailable at any time or for any period. It is a condition of your use of the Website that all the information you provide on the Website is correct, current, and complete. You agree to promptly update your account information to maintain its accuracy and completeness. You agree that all information you provide to register with this Website or otherwise, including, but not limited to, through the use of any interactive features on the Website, is governed by our Privacy Policy, and you consent to all actions we take with respect to your information consistent with our Privacy Policy.

The disclaimers herein and all restrictions on you regarding information downloaded or obtained from the Site shall survive any cancellation or termination of your right to use the Site. We will fully cooperate with any law enforcement authorities or court orders related to submissions that violate applicable law or these Terms and you waive and hold us harmless for any such cooperation. Upon receipt of your request, we will process your account closure within thirty (30) days. You acknowledge that account closure is permanent and cannot be undone. Following account closure, your access to the Website will be terminated, and your personal data will be handled in accordance with our Privacy Policy and applicable data retention laws. 14. User Contributions & Submissions

14.1 Submissions: Areas of the Site may permit you to provide feedback or send materials to us, including for use on the Site.
