Ordering and Payment Information

1. Ordering & Payment

Order Acceptance: Your placement of an order on our Website constitutes an offer to purchase the Products. Our acceptance of your order occurs when we send you an email confirmation indicating that your order has been shipped. We reserve the right to refuse or cancel any order for any reason, including but not limited to Product unavailability, errors in pricing or product descriptions, or suspected fraudulent activity.

Payment Methods: We accept various payment methods, including major credit cards (Visa, MasterCard, American Express, Discover), debit cards, Shop Pay, Apple Pay, Google Pay, and Shop Pay Installments (powered by Affirm), Paypal and Venmo. By providing payment information, you represent and warrant that you are authorized to use the designated payment method.

Payment Processing: Payment authorizations are applied at the time of order placement and the charge will be incurred after each shipment is fulfilled. In the event of a failed payment, chargeback, or reversal, you agree to be responsible for any resulting fees or losses incurred by us. We reserve the right to pursue collection of any unpaid amounts.

2. Shop Pay and Shop Pay Installments

General Shop Pay: Shop Pay is an accelerated checkout service (including major credit cards and third-party payment services like Google Pay and Apple Pay) that allows you to save your payment and shipping information for faster future purchases. Your use of Shop Pay is subject to Shopify's terms and conditions and privacy policy.

Shop Pay Installments (Powered by Affirm):

a) Overview: Shop Pay Installments allows you to split your purchase into bi-weekly or monthly payments. This service is provided by Affirm and is subject to their credit approval and separate terms and conditions.

b) Eligibility: Eligibility for Shop Pay Installments is determined by Affirm and may depend on factors such as your creditworthiness (a soft credit check may be performed for bi-weekly payments; monthly payments may involve a credit check that could impact your credit score), your location (currently available for eligible customers in the U.S. and Canada, excluding Quebec), and the total order value. Not all products or orders may be eligible for Shop Pay Installments (e.g., gift cards, subscriptions, and certain B2B purchases are typically excluded).

c) Payment Schedule & Fees: Bi-weekly Payments: For purchases typically between $50 - $999.99 USD, you may be eligible for four interest-free bi-weekly payments.

d) Monthly Payments: For purchases typically between $150 - $17,500 USD, you may be eligible for monthly payments, which may be interest-bearing. There are generally no late fees for Shop Pay Installments, but terms may vary, and you should always refer to the specific terms provided by Affirm at the time of your loan agreement.

e) Direct Relationship with Affirm: When you choose Shop Pay Installments, you are entering into a loan agreement directly with Affirm (or their lending partners), not with Restful Nights or Live Comfortably, LLC. We receive the full payment for your order from Shopify, and your repayment obligations are solely with Affirm.

f) Customer Support for Installments: For any questions regarding your Shop Pay Installments account, eligibility, payment schedule, or loan terms, please contact Shop Pay support directly at Shop Pay Help Center or Affirm customer service. Live Comfortably, LLC does not have access to your loan information.

g) Promotional Disclosures: Any promotional offers or examples related to Shop Pay Installments on our Website are for illustrative purposes. Your actual loan terms, interest rates, and approval are subject to Affirm's assessment and will be presented to you during the checkout process.

3. Taxes

State sales tax will be calculated and reflected in your Order Summary at checkout, after the shipping address has been entered. Sales tax is applicable to the following states including taxes collected by individual counties therein: Alabama, Arizona, Arkansas, California, Colorado, Connecticut, Florida, Georgia, Hawaii, Idaho, Illinios, Indiana, Kentucky, Louisiana, Maine, Maryland, Massachusetts, Michigan, Minnesota, Missouri, Nebraska, Nevada, New Jersey, New York, North Carolina, North Dakota, Ohio, Oklahoma, Pennsylvania, Rhode Island, South Carolina, South Dakota, Tennessee, Texas, Utah, Vermont, Virginia, Washington, West Virginia, Wisconsin, and Wyoming.

 

4. Shipping and Delivery

Shipping Costs: Shipping costs will be calculated and displayed at checkout.

Delivery Times: Estimated delivery times are provided for your convenience but are not guaranteed. Delays may occur due to unforeseen circumstances or carrier issues. We are not responsible for delays caused by the shipping carrier or customs.

Risk of Loss: The risk of loss and title for Products purchased from the Website pass to you upon our delivery to the carrier.

 

 

5. Returns, Refunds, and Exchanges

Return Policy: We accept returns of unused and undamaged Products within 30 days upon receiving delivery. To initiate a return, please visit our Returns Policy page.

Refund Process: Refunds will be processed to the original payment method used for the purchase.

a) For standard payments (credit card, debit card, Apple Pay, Google Pay, Shop Pay, Paypal, Venmo): Refunds will be issued back to your original payment method within 7-10 business days after the returned Product is received and inspected.

b) For Shop Pay Installments: Once we process your refund for a Shop Pay Installments purchase, Affirm/Shop Pay will adjust your loan balance. If you have made payments that exceed the adjusted balance, Affirm will refund the overpayment to your original payment method. Any interest paid on interest-bearing loans is generally non-refundable by Affirm. Please allow time for Affirm to process the refund to your account.

Exchanges: We do not offer direct exchanges. Please return the unwanted item for a refund and place a new order for the desired item.
